The Kentucky Attorney General issued the following open records decisions last week:

1. 24-ORD-014 (In re: Meldrum G. Harvey/Green RiverCorrectional Complex)

Summary: The Green River Correctional Complex did not violate the Open Records Act when it denied a request for a record that does not contain a specific reference to the inmate requester.

2. 24-ORD-015 (In re: Evan Doyle/Louisville Metro Government)

Summary: Louisville Metro Government subverted the intent of the Open Records Act within the meaning of KRS 61.880(4), when it delayed access to records for nearly two months without proper justification.

3. 24-ORD-016  (In re: Mike Doyle/Louisville Metro Government)

Summary: Louisville Metro Government did not violate the Open Records Act when it withheld an email that was exempt from disclosure under KRS 61.878(1)(j).

4. 24-ORD-017 (In re: Michael R. Carter/Board of Cosmetology)

Summary: The Board of Cosmetology did not violate the Open Records Act when it did not provide records that do not exist.

5. 24-ORD-018 (In re: Michael R. Carter/Board of Cosmetology)

Summary: The Board of Cosmetology did not violate the Open Records Act when it did not provide records that do not exist.

6. 24-ORD-019 (In re: Vivian Miles/Kentucky State Police)

Summary: The Kentucky State Police violated the Open Records Act when it failed to issue a timely response and failed to respond to a portion of a request. However, KSP did not violate the Act when it produced all responsive records it possesses.

7. 24-ORD-020 (In re: Laura O’Brien/Boone County School District)

Summary: The Boone County School District violated the Open Records Act when it failed to notify the requester whether it was complying within the five-day period after receiving the request, as required by KRS 61.880(1), and when it did not properly invoke KRS 61.872(5) to delay access to the records.

8. 24-ORD-021 (In re: Lawrence Trageser/Okolona Fire Protection District)

Summary: The Okolona Fire Protection District did not violate the Open Records Act when it denied requests for public records because the requester did not state whether the requests were for a commercial purpose.

9. 24-ORD-022 (In re: Kevin Zipperle/University of Louisville Athletics Association)

Summary: The University of Louisville Athletics Association did not violate the Open Records Act when it could not provide records that do not exist. The Association subverted the intent of the Act, within the meaning of KRS 61.880(4), when it delayed a final response to a request beyond five business days, did not properly invoke KRS 61.872(5), and failed to dispense with the request on the date by which it had committed to respond.
