The Kentucky Attorney General issued the following open records and open meetings decisions last week:

1. 24-ORD-159 (In re: Campbell County Board of Education/Department of Revenue)

Summary: The Department of Revenue violated the Open Records Act when it failed to respond to a request for records within five business days. The Department also violated the Act when it withheld records in their entirety under KRS 131.190(1), instead of redacting the confidential information as required by KRS 61.878(4).

2. 24-OMD-160 (In re: Robert Mattheu/Cassidy Elementary School-Based Decision-Making Council)

Summary: The Cassidy Elementary School-Based Decision-Making Council violated the Open Meetings Act when it failed to properly document votes taken at its February 26 and March 25, 2024, meetings.

3. 24-ORD-161 (In re: Nathan McCamish/Lexington–Fayette Urban County Government)

Summary: Because the requester has made a prima facie case that a public record should exist, the Lexington–Fayette Urban County Government violated the Open Records Act when it failed to explain the adequacy of its search for the record.
