The Kentucky Attorney General issued the following open records decisions last week:



1. 22-ORD-138 (In re: Dean Dresel/City of Muldraugh)



Summary: The City of Muldraugh did not violate the Open Records Act when it denied a request for information. This Office cannot find that the City violated the Act for failing to respond to a request within five business days.

2. 22-ORD-139 (In re: Spencer Stone/Board of Social Work)

 

Summary: The Board of Social Work violated the Open Records Act when it failed to respond in writing to a request for records in accordance with KRS 61.880(1). The Board did not violate the Act when it did not provide a copy of an administrative regulation that was nonresponsive to the request.

3. 22-ORD-140 (In re: Spencer Stone/Jefferson County Family Court)

 

Summary: The Open Records Act does not apply to records of the Jefferson County Family Court.

4. 22-ORD-141 (In re: Spencer Stone/Board of Examiners of Psychology)

 

Summary: The Board of Examiners of Psychology violated the Open Records Act when it denied inspection of certain records without explaining how KRS 61.878(1)(l) applied to those records. However, the Board did not violate the Act when it did not provide records that do not exist.

5. 22-ORD-142 (In re: Mark Graham/Christian County Clerk’s Office)

 

Summary: The Office cannot find that the Christian County Clerk’s Office failed to respond to a request submitted under the Open Records Act within five business days when the Clerk provided proof that a timely response was issued.

6. 22-ORD-143 (In re: David Pennington/Floyd County Board of Education)

 

Summary: This Office cannot find that the Floyd County Board of Education violated the Open Records Act when it attempted to fulfill a request for information.

7. 22-ORD-144 (In re: David Webster/Christian County Board of Education)

 

Summary: The Christian County Board of Education did not violate the Open Records Act when it withheld communications between staff and Board members that were exempt from disclosure under KRS 61.878(1)(a), (i), (j), (l), or (r).

8. 22-ORD-145 (In re: Dennis Bell/McCracken County Sheriff’s Office)

 

Summary: The McCracken County Sheriff’s Office violated the Open Records Act when it failed to respond to a request for records.
