The Kentucky Attorney General issued the following open records decisions last week:
1. 24-ORD-262 (In re: Christeena Gallahue/Oldham County School District)
Summary: The Oldham County School District violated the Open Records Act when it denied a portion of a request as too imprecise. The District did not violate the Act when it denied a portion of the request that did not seek “public records” as defined by KRS 61.870(2).

2. 24-ORD-263 (In re: Carl Adkins/Kentucky State Penitentiary)
Summary: The Kentucky State Penitentiary did not violate the Open Records Act when it denied a request for JPay emails between private parties because such records are not “public records” under KRS 61.870(2).

3. 24-ORD-264 (Delbert Harper/Roederer Correctional Complex)
Summary: The Office cannot find the Roederer Correctional Complex violated the Open Records Act because the Office cannot resolve the factual dispute between the parties.

4. 24-ORD-265 (In re: Jody B. Franklin/Morgan County Water District)
Summary: The Morgan County Water District violated the Open Records Act when it failed to appropriately respond to a request under the Act.

5. 24-ORD-266 (In re: Helen Campbell/Perry County E-911 Center)
Summary: The Perry County E-911 Center violated the Open Records Act when it denied a request for public records on the basis of residency when the requester stated how she qualified as a resident of the Commonwealth under KRS 61.870(10).

6. 24-ORD-267 (In re: Saeid Shafizadeh/City of Stamping Ground)
Summary: The Office cannot find that the City of Stamping Ground violated the Open Records Act because it cannot resolve the factual dispute between the parties as to whether the City received a request to inspect records.

Summary: The Kentucky Department of Corrections did not violate the Open Records Act when it denied a request for a record that does not specifically reference the requesting inmate or when it denied a request for information.
