The Kentucky Attorney General issued the following open records decisions last week:

1. 24-ORD-240

(In re: Jeffrey Skiles/Western Kentucky Correctional Complex)

Summary: The Western Kentucky Correctional Complex did not violate the Open Records Act when it denied a request for records posing a security threat under KRS 197.025(1).

2. 24-ORD-241

(In re: Alan S. Rubin/Jefferson County Public Schools)

Summary: Jefferson County Public Schools) did not violate the Open Records Act when it denied a request for a copy of school surveillance video and an incident report under KRS 61.878(1)(k) and 20 U.S.C. § 1232g.

Summary: The Bell County Fiscal Court did not violate the Open Record Act when it did not respond to a request it claims it did not receive.

Summary: The Cold Spring Police Department did not violate the Open Records Act when it denied a request for a letter collected at the scene of a suicide under KRS 61.878(1)(a).

(In re: Uriah Pasha/Kentucky Parole Board)

Summary: The Office cannot find that the Kentucky Parole Board violated the Open Records Act because the Office cannot resolve the factual dispute between the parties.

Summary: A member of the Elsmere City Council did not violate the Open Records Act when she denied a request that did not seek records prepared, owned, used, in the possession of, or retained by the Councilwoman.

(In re: Christopher Hunt/Commonwealth’s Attorney, 34th Judicial Circuit)

Summary: The Commonwealth’s Attorney for the 34th Judicial Circuit did not violate the Open Records Act when he denied under KRS 61.878(1)(h) a request for records contained in his criminal investigation or litigation files.
