The Kentucky Attorney General issued the following open records decisions last week:

1. 21-ORD-174 (In re: Terrance Miles/Southeast State Correctional Complex)

Summary: The Southeast State Correctional Complex did not violate the Open Records Act when it denied requests for a record that does not exist and for records that do not contain a specific reference to the requesting inmate.

2. 21-ORD-175 (In re: Christopher Sawyer/Kenton Circuit Court Clerk)

Summary: The Open Records Act does not apply to records of the Kenton Circuit Court Clerk.

3. 21-ORD-176 (In re: Donna Bischoff/University of Kentucky)

Summary: The University of Kentucky did not violate the Open Records Act when it did not respond to a request to inspect records that it never received.

4. 21-ORD-177 (In re: Aaron Kidd/Madison County Detention Center)

Summary: The Madison County Detention Center violated the Open Records Act when its response to a request to inspect records failed to comply with KRS 61.880(1). The Center carried its burden on appeal that it adequately searched for some responsive records, but failed to carry its burden that other aspects of the request were unreasonably burdensome.

5. 21-ORD-178 (In re: Mike O'Donnell/Bullitt County Board of Education)

Summary: The Bullitt County Board of Education violated the Open Records Act when it failed to conduct an adequate search for records, but did not violate the Act when it denied a request for information that did not constitute an existing public record.

6. 21-ORD-179 (In re: Austin Horn/Kentucky State University Foundation)

Summary: The Kentucky State University Foundation is a public agency and it violated the Open Records Act when it denied a request to inspect records.
