The Kentucky Attorney General issued the following open records decisions last week:

1. 21-ORD-046 (In re: Samuel Hayward, Jr./Kentucky Labor Cabinet)

Summary: The Kentucky Labor Cabinet did not violate the Open Records Act when it provided records that were responsive to a request.

2. 21-ORD-047 (In re: Jenny Patten/Cabinet for Health and Family Services)

Summary: Because the Cabinet for Health and Family Services failed to respond to an open records request within ten days, it violated the Open Records Act as modified by Senate Bill 150. The Cabinet also violated the Act when it did not produce records that should exist pursuant to a contract with a COVID-19 testing provider.

3. 21-ORD-048 (In re: The Courier-Journal/Department of Corrections)

Summary: The Department of Corrections violated the Open Records Act when it redacted the race and sex of formerly incarcerated individuals on grounds of personal privacy. The Department did not violate the Act when it redacted dates of birth under KRS 61.878(1)(a).

4. 21-ORD-049 (In re: Tyler Fryman/Louisville Metro Police Department)

Summary: Louisville Metro Police Department did not violate the Open Records Act by denying a request for records relating to an incident that remains under criminal investigation.
