The Kentucky Attorney General issued the following open records decisions last week:

1. 21-ORD-035 (In re: Christopher Wiest/Department of Alcoholic Beverage Control)

Summary: The Department of Alcoholic Beverage Control violated the Open Records Act when it failed to explain how the statutory exceptions applied to the particular records it withheld, as required under KRS 61.880(1). The Department did not meet its burden of proof on appeal to sustain its decision to withhold timesheets reflecting attorney work.

2. 21-ORD-036 (In re: Jeff Carpenter/Kentucky State Penitentiary)

Summary: The Kentucky State Penitentiary did not violate the Open Records Act when it did not respond to a request for records it did not receive.

Summary: The Kentucky State Police did not violate the Open Records Act when it denied a request for records that no longer exist.

Summary: The Personnel Cabinet did not violate the Open Records Act when it did not provide records that do not exist in its possession.

6. 21-ORD-040 (In re: Glen Odom/Oldham County Coroner's Office)

Summary: The Oldham County Coroner's Office discharged its duty under the Open Records Act when it directed the requester to the records custodian of the public agency in possession of the requested record.
