The Kentucky Attorney General issued the following open records decisions last week:

1. 20-ORD-183 (In re: Dinsmore & Shohl/Laurel County Correctional Center)

Summary: The Laurel County Correctional Center violated the Open Records Act when it failed to issue a timely written response denying a request for records and when it denied requested records as confidential and proprietary information.

2. 20-ORD-184 (In re: Charlie Dietz/Kentucky Labor Cabinet)

Summary: The Kentucky Labor Cabinet violated the Open Records Act when it withheld the names of private individuals who submitted complaints to the KY-SAFER Hotline.

3. 20-ORD-185 (In re: Charlie Dietz/Northern Kentucky Health Department)

Summary: The Northern Kentucky Health Department did not violate the Open Records Act when it redacted the names of private individuals from public complaints it received alleging noncompliance with executive orders relating to COVID-19 because the Department does not issue notices of violation based upon unverified complaints.

4. 20-ORD-186 (In re: Stephen Zoglman/Daviess County Board of Education)

Summary: The Office of Attorney General is unable to settle disputes between the public and a public agency regarding a claim that the public agency should have produced additional records in response to a request made under the Open Records Act.
