The Kentucky Attorney General issued the following open records decisions last week:

1. 20-ORD-147 (In re: American Oversight/Office of Attorney General)

Summary: The Office of Attorney General did not violate the Open Records Act in denying a request for records relating to the potential prosecution of election law violations. The Office also did not violate the Act by denying inspection of emails that relate to the Attorney General's calendar appointments and meeting schedules.

2. 20-ORD-148 (In re: Robert Brandon Jones/Laurel County Schools District)

Summary: Under 40 KAR 1:030 § 4, the Attorney General may not reconsider a prior decision rendered under the Open Records Act. This Office will not reconsider 20-ORD-021, in which it found that Laurel County Schools District did not violate the Act by withholding public records that were part of an ongoing investigation under KRS 61.878(1)(i) and KRS 61.878(1)(j). The District violated the Act by denying a request for public records as "not timely" under KRS 161.011(5)(a) without citing an exemption from the Act.

3. 20-ORD-149 (In re: Taquan Neblett/Kentucky State Reformatory)

Summary: Kentucky State Reformatory did not violate the Open Records Act in denying an inmate's request for a record that did not contain a specific reference to him.

4. 20-ORD-150 (In re: Scott Thomas/Cabinet for Health and Family Services)

Summary: Cabinet for Health and Family Services violated the Open Records Act by failing to make final disposition of an open records request within three business days. Under KRS 620.050(11), "[i]dentifying information concerning the individual initiating [a] report" of dependency, neglect, or abuse may not be disclosed except under certain specific circumstances, none of which apply here, and the Cabinet did not violate the Act in making these redactions to records produced.
