The Kentucky Attorney General issued the following open records and open meetings decisions last week:

1. 20-OMD-158 (In re: Glenn Hayden/Graves County School Board)

Summary: Social media posts by individual members of public agencies regarding matters over which the agency has no authority to take action are not "meetings" under the Open Meetings Act. There is no evidence in the record to support a finding that the Graves County School Board held a series of meetings with less than a quorum present for the purposes of avoiding the requirements of the Act.

2. 20-ORD-159 (In re: James Lang/Oldham County Health Department)

Summary: Oldham County Health Department failed to make a disposition of an open records request within the statutory time period. The Department did not violate the Open Records Act by failing to provide records that did not exist or by denying a request as one for information.
