The Kentucky Attorney General issued the following open records and open meetings decisions last week:

1. 20-ORD-159 (In re: James Lang/Oldham County Health Department)

Summary: Oldham County Health Department failed to make a disposition of an open records request within the statutory time period. The Department did not violate the Open Records Act by failing to provide records that did not exist or by denying a request as one for information.

2. 20-ORD-160 (In re: Glenn Hayden/Graves County School Board)

Summary: The Graves County School Board discharged its duties under the Open Records Act when it produced records responsive to a request. Appellant's claims are unperfected and nonjusticiable in this forum.

3. 20-ORD-161 (In re: Jeffery Walther/Cabinet for Health and Family Services)

Summary: The Cabinet for Health and Family Services violated the Open Records Act when it denied a person previously suspected of causing dependency, abuse, or neglect from inspecting the case assessment against him.

4. 20-ORD-162 (In re: William Van Cleve/City of Ravenna)

Summary: City of Ravenna did not violate the Open Records Act by failing to provide records that it did not possess.

5. 20-OMD-163 (In re: The State Journal/Frankfort Board of Commissioners)

Summary: Frankfort Board of Commissioners engaged in conduct prohibited under the Open Meetings Act by conducting a series of less-than-quorum meetings where the members attending collectively constituted a quorum and discussed public business. Even so, insufficient evidence exists to establish the Board's intent to violate the Act.

6. 20-ORD-164 (In re: Donald Phillips/Office of the Secretary of State

Summary: The Office of the Secretary of State did not violate the Open Records Act when it denied inspection of a record that did not exist.
