The Kentucky Attorney General issued the following open records and open meetings decisions last week:

1. 21-ORD-015 (In re: Randy Whitson/Little Sandy Correctional Complex

Summary: The Little Sandy Correctional Complex violated the Open Records Act when it failed to notify an inmate that it did not possess the records sought. However, the Complex did not violate the Act when it denied a request that did not precisely describe the records sought.

2. 21-ORD-016 (In re: Terry Goodspeed/Louisville Metro Police Department)

Summary: The Louisville Metro Police Department violated the Open Records Act when it failed to identify the appropriate exception authorizing it to deny a request for records. However, the Department carried its burden on appeal to demonstrate that the requested records are exempt under KRS 17.150(2).

3. 21-ORD-017 (In re: Jenny Patten/Cabinet for Health and Family Services)

Summary: The Cabinet for Health and Family Services did not violate the Open Records Act when it denied a request for information that did not sufficiently describe the public records sought.

4. 21-OMD-018 (In re: Jason Reed/Cold Spring City Council)

Summary: The Cold Spring City Council violated the Open Meetings Act when it took action on an item discussed in closed session after publicly stating that no such action would be taken. The Council also violated the Act's procedural requirements.

5. 21-ORD-019 (In re: Glen A. Davis/Georgetown Police Department)

Summary: The Georgetown Police Department did not violate the Open Records Act when it did not respond to a request for records that it did not receive.

Summary: The Scott County Sheriff's Office violated the Open Records Act by failing to timely respond to an inmate's request for records.
