The following Kentucky Attorney General Open Records/Open Meetings Decisions were issued last week:

1. 20-ORD-095 (In re: WPSD Local 6 News/Office of Marshall County Judge/Executive)

Office of Marshall County Judge/Executive did not violate the Open Records Act in denying a request for nonexistent records because a public agency cannot provide records it does not possess. The Judge/Executive's Office properly relied on KRS 61.878(1)(i) as the basis for denying access to communications between it and a private individual.

2. 20-ORD-096 (In re:

Andrew Mize/Carter County School District; and Andrew Mize/Grayson Police Department)

Carter County School District violated the Open Records Act by failing to state affirmatively that the requested records did not exist in its possession. The Grayson Police Department violated the Act by failing to respond to a request for records.

3. 20-ORD-097 (In re: Gerardo Rodriguez/Kentucky State Penitentiary)

Kentucky State Penitentiary did not violate the Open Records Act by failing to produce a record that did not exist in its possession.

4. 20-ORD-098 (In re: Leonel Martinez/Kentucky State Penitentiary)

Kentucky State Penitentiary did not violate the Open Records Act in denying a request for information.

5. 20-ORD-099 (In re: Melissa Stone/University of Louisville)

The University of Louisville violated the Open Records Act by requiring a requester to provide a "sworn, notarized statement" attesting to the noncommercial purpose of her request to inspect records.
