The following Kentucky Attorney General Open Records Decisions were issued last week. The open records or meetings decision that should have been assigned 20-105 was omitted by the OAG.

1. 20-ORD-103 (In re: Timothy Lewis/Jefferson Circuit Court Clerk)

Summary: Because he is not bound by the provisions of the Open Records Act, the Jefferson Circuit Court Clerk did not violate the Act in the disposition of a request for records.

2. 20-ORD-104 (In re: The Courier-Journal/Louisville Metro Police Department)

Summary: Louisville Metro Police Department did not violate the Open Records Act by denying a request for the "full investigative file" relating to dismissed charges against Kenneth Walker. On appeal, the Department justified its reliance on KRS 17.150(2)(d) to withhold the investigating file because disclosure would reveal information pertaining to prospective law enforcement actions.

3. 20-ORD-106 (In re: The Courier-Journal/Louisville Metro Emergency Services)

Summary: Louisville Metro Emergency Services did not violate the Open Records Act by denying a request for a dispatch report and recordings of radio transmissions under KRS 17.150(2). LMES substantiated on appeal that disclosure would impede pending investigations by the Federal Bureau of Investigation and the Office of the Attorney General by revealing information to be used in prospective law enforcement action.

4. 20-ORD-107 (In re: The Courier-Journal/Louisville Metro Police Department)

Summary: Louisville Metro Police Department did not violate the Open Records Act by denying requests for administrative incident reports and body camera footage under KRS 17.150(2). The Department substantiated on appeal that disclosure would impede pending investigations by the Federal Bureau of Investigation and the Office of the Attorney General by revealing information to be used in prospective law enforcement actions.

5. 20-ORD-108 (In re: Timothy Lewis/Bureau of Alcohol, Tobacco, Firearms and Explosives – Louisville Field Office)

Summary: Bureau of Alcohol, Tobacco, Firearms and Explosives' Louisville Field Office is a federal agency to which the Freedom of Information Act applies, not a "public agency" under KRS 61.870(1) to which the Open Records Act applies.

6. 20-ORD-109 (In re: Ben Richard, Jr./Luther Luckett Correctional Complex)

Summary: Luther Luckett Correctional Complex did not violate the Open Records Act in denying access to emails transmitted between private parties and an inmate using the JPay email service.
