The following Kentucky Attorney General Open Records and Meetings Decisions were issued last week.

1. 20-OMD-126 (In re: David A. Guidugli/Cold Spring City Council)

Summary: The Cold Spring City Council complied with all of the notice requirements for special meetings under KRS 61.823 prior to holding its April 27, 2020, meeting and therefore the City Council did not violate the Open Meetings Act.

2. 20-ORD-127 (In re: William Boyer/Luther Luckett Correctional Complex)

Summary: Luther Luckett Correctional Complex did not violate the Open Records Act in denying access to e-mails transmitted between private parties and an inmate using the JPay e-mail service.

3. 20-ORD-128 (In re: Brennan Crain/Kentucky State Police)

Summary: The Kentucky State Police did not violate the Open Records Act in denying a request to inspect records related to an ongoing and active police investigation.

4. 20-ORD-129 (In re: Christian Goins/Green River Correctional Complex)

Summary: Green River Correctional Complex properly denied an inmate request for a specified JPay e-mail message on the basis of KRS 197.025(1), incorporated into the Open Records Act ("Act") by KRS 61.878(1)(l), because disclosure would constitute a security threat to the inmate requester, other inmates, and Complex staff.

5. 20-ORD-130 (In re: Keith M. Owens/Northpoint Training Center)

Summary: Northpoint Training Center did not violate the Open Records Act in denying an inmate's request for a specified policy because it did not contain a specific reference to him.

6. 20-ORD-131 (In re: Sam Aguiar/Louisville Metro Police Department

Summary: Louisville Metro Police Department violated the Open Records Act by failing to fully respond to a request to inspect records. However, the Department did not violate the Act by denying requests for certain Risk Assessment Matrix forms, recordings of radio traffic, and Mobile Data Terminal communications under KRS 17.150(2). The Department substantiated on appeal that disclosure would impede pending investigations by the Federal Bureau of Investigation and the Office of the Attorney General by revealing information to be used in prospective law enforcement actions.

7. 20-ORD-132 (In re: Clester Mullins/Luther Luckett Correctional Complex)

Summary: The Luther Luckett Correctional Complex did not violate the Open Records Act in denying a request for JPay emails sent from a private party to an inmate.
