In re: Kerry R. Porter, Sr./Jefferson County Corrections Department

 

Open Records Decision

 

This matter having been presented to the Attorney General in an open records appeal, and the Attorney General being sufficiently advised, we find that Jefferson County Corrections Department properly relied on KRS 197.025(1), incorporated into the Open Records Act by operation of KRS 61.878(1)(l), in denying Kerry R. Porter, Sr.s request for a copy of the Community Correction Center visitation sign-in log roster reflecting visit(s) to inmate Greg Gulley or Gregory Gulley by any law enforcement official, for the period of January 22, 1997 through April, 1997. We believe that 96-ORD-179 and 99-ORD-199 are controlling. A copy of those decisions are attached hereto and incorporated by reference. Accordingly, we find that the Jefferson County Corrections Department properly denied Mr. Porters request.

 

        A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
