Open Meetings Decision

This matter having been presented to the Attorney General in an open meetings appeal, and the Attorney General being sufficiently advised, we find that the Harrodsburg City Commission violated the Open Meetings Act at its February 23, 1999, regular meeting by failing to comply with the requirements of KRS 61.815(1) and KRS 61.810(1)(f) before going into a closed session. We further find that the commission violated KRS 61.846(1) by failing to respond to The Harrodsburg Herald's February 25, 1999, open meetings complaint in writing and within three business days. It is the opinion of this office that 99-OMD-49, a copy of which is attached hereto and incorporated by reference, is controlling.

A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.846(5). The Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
