The Kentucky Attorney General issued the following open records decisions last week:

1. 23-ORD-250 (In re: David Webster/Christian County Board of Education)

Summary: The Christian County Board of Education violated the Open Records Act when it initially failed to explain how exceptions to the Act applied to certain records. However, the Board did not violate the Act when it denied a request for a draft agenda for a proposed special meeting that did not occur.

2. 23-ORD-251 (In re: Adam Lye/Oldham County Board of Education)

Summary: The Oldham County Board of Education did not violate the Open Records Act when it determined a request posed an unreasonable burden under KRS 61.872(6). The Board violated the Act when it relied on KRS 61.872(3)(b) to deny a request to inspect in person the records it reasonably described. However, the Board did not violate the Act when it denied another request that did not reasonably describe the records to be inspected.

3. 23-ORD-252 (In re: William Aucott/ Northpoint Training Center)

Summary: The Northpoint Training Center did not violate the Open Records Act when it did not provide records that are exempt from disclosure under federal law.

4. 23-ORD-253 (In re: Bill Hollander/Louisville Metro Government)

Summary: The Louisville Metro Government violated the Open Records Act when it did not respond to a request to inspect records.

5. 23-ORD-254 (In re: Michael Howard/Kentucky Department of Corrections)

Summary: The Kentucky Department of Corrections did not violate the Open Records Act when it did not provide the Appellant with a free copy of his medical records.

6. 23-ORD-255 (In re: Kurt Wallace/Louisville Free Public Library)

Summary: The Louisville Free Public Library violated the Open Records Act when it failed to publish on its website its rules and regulations for submitting a request to inspect public records and the contact information of its official records custodian. The Library also violated the Act when it responded to a request with instructions to use a particular form rather than providing the contact information of its official records custodian to whom the request should be submitted.
