The Kentucky Attorney General issued the following open records decisions last week:

1. 23-ORD-121 (In re: Jamie Green/Green River Correctional Complex)

Summary: The Green River Correctional Complex violated the Open Records Act when it relied on an inapplicable exemption, and failed to explain how it applied, to deny the Appellant’s request to view his medical file alongside another inmate.

2. 23-ORD-122 (In re: Allen Wiley, III/Department of Public Advocacy)

Summary: This Office cannot find that the Department of Public Advocacy violated the Open Records Act when it did not respond to a request it claims it did not receive.

3. 23-ORD-124 (In re: Anthony Leeds/Eastern Kentucky Correctional Complex)

Summary: The Eastern Kentucky Correctional Complex did not violate the Open Records Act when it denied a request for records that did not contain a specific reference to the inmate requester.

4. 23-ORD-125 (In re: Juanisha Jamison/Louisville Metro Police Department)

Summary: The Louisville Metro Police Department violated the Open Records Act when it failed to explain why it redacted records and when it failed to respond timely to a request to inspect records. The Department also subverted the intent of the Act under KRS 61.880(4) by belatedly invoking KRS 61.872(5) to excessively extend its time to produce records without meeting its burden of proof that additional delay was necessary.

5. 23-ORD-126 (In re: Latonya Jamison/Louisville Metro Police Department)

Summary: The Louisville Metro Police Department violated the Open Records Act when it failed to timely respond to an open records request. The Department also subverted the intent of the Act under KRS 61.880(4) by belatedly invoking KRS 61.872(5) to excessively extend its time to produce records without meeting its burden of proof that additional delay was necessary.

6. 23-ORD-127 (In re: Carlos Thurman/Green River Correctional Complex)

Summary: The Green River Correctional Complex violated the Open Records Act when it denied a request to inspect records that adequately described the records sought.

7. 23-ORD-128 (In re: Westley Moyer/Edmonson County Attorney’s Office)

Summary: The Edmonson County Attorney’s Office violated the Open Records Act when it failed to cite an exception authorizing it to deny a request to inspect records or explain how it applied.
