The Kentucky Attorney General issued the following open records decisions last week:

1. 22-ORD-219 (In re: Bridgette Ehly/Oldham County Clerk)

Summary: The Oldham County Clerk did not violate the Open Records Act when she did not provide electronic copies of the voter signature rolls from the May 2022 primary election because the Clerk does not maintain the records in electronic format.

2. 22-ORD-220 (In re: David Johnson/Kentucky State Police)

Summary: The Kentucky State Police did not violate the Open Records Act when it did not provide electronic copies of a database that is exempt from inspection under KRS 237.110(10).

3. 22-ORD-221 (In re: David Costas/City of Park Hills)

Summary: The City of Park Hills violated the Open Records Act when it denied a request as vague and unduly burdensome under KRS 61.872(6).

4. 22-ORD-222 (In re: Brandon Dawson/Eastern Kentucky Correctional Complex)

Summary: The Eastern Kentucky Correctional Complex did not violate the Open Records Act when it did not provide records that do not exist.

5. 22-ORD-223 (In re: Rodney Smith/Kentucky State Penitentiary)

Summary: The Kentucky State Penitentiary did not violate the Open Records Act when it redacted information that, if released, would pose a security threat under KRS 197.025(1).

6. 22-ORD-224 (In re: Carlos Harris/Eastern Kentucky Correctional Complex)

Summary: The Eastern Kentucky Correctional Complex violated the Open Records Act when it failed to respond fully to a request within five business days of receiving it. However, the Complex did not violate the Act when it denied a request for a record that does not exist within its possession. An agency is not required to create a record to satisfy a request under the Act.

7. 22-ORD-225 (In re: Samuel Turner/Western Kentucky Correctional Complex)

Summary: The Western Kentucky Correctional Complex did not violate the Open Records Act when it denied a request for records which, if released, would pose a security threat under KRS 197.025(1).
