The Kentucky Attorney General issued the following open records decisions last week:

1. 23-ORD-224 (In re: Alastair Couch/Fayette County Commonwealth’s Attorney)

Summary: The Fayette County Commonwealth’s Attorney did not violate the Open Records Act when she withheld records pertaining to criminal litigation under KRS 61.878(1)(h).

2. 23-ORD-225 (In re: Melanie Barker/Cabinet for Health and Family Services)

Summary: The Cabinet for Health and Family Services violated the Open Records Act when it failed to respond properly to a request to inspect records within five business days and when it denied the Appellant’s request for certain emails sent over a seven-month period.

3. 23-ORD-226 (In re: Alan Williams/Boyd Circuit Court Clerk)

Summary: The Open Records Act does not apply to records of the Boyd Circuit Court Clerk.

4. 23-ORD-227 (In re: Shawntele Jackson/Louisville Metro Police Department)

Summary: The Office is unable to find that the Louisville Metro Police Department violated the Open Records Act when it did not respond to a request that it did not receive.
