The Kentucky Attorney General issued the following open records decisions last week:
1. 22-ORD-252 (In re: James Clemons/Garrard Circuit Court Clerk)
Summary: The Open Records Act does not apply to records of the Garrard Circuit Court Clerk.

2. 22-ORD-253 (In re: Jennifer Morris/McCracken County Sheriff’s Office)
Summary: The McCracken County Sheriff’s Office did not violate the Open Records Act when it did not provide the subject of a body-worn camera recording with a copy of the recording.

3. 22-ORD-254 (In re: Farrand Skinner/Breckinridge County Jail)
Summary: The Breckinridge County Jail violated the Open Records Act when it failed to issue a response to a request to inspect records. The Jail did not violate the Act when it did not provide records that do not exist in its possession.

4. 22-ORD-255 (In re: Charlotte Flanary/Office of the Treasurer)
Summary: The Office of the Treasurer violated the Open Records Act when it denied a request for copies of “[a]ny email or correspondence” between two named individuals. The request precisely described the records sought, and the agency has not carried its burden that this particular request was an unreasonable burden or an attempt to disrupt the agency’s essential functions under KRS 61.872(6).
