The Kentucky Attorney General issued the following open records decisions last week:

1. 23-ORD-062 (In re: Glenn Odom/Kentucky State Penitentiary)

Summary: This Office cannot find that the Kentucky State Penitentiary violated the Open Records Act when it provides proof it timely issued responses to requests to inspect records.

2. 23-ORD-063 (In re: Carlos Harris/Eastern Kentucky Correctional Complex)

Summary: Because the requester has made a prima facie case that public records should exist, the Eastern Kentucky Correctional Complex violated the Open Records Act when it failed to explain the adequacy of its search for the records. The Complex did not violate the Act when it denied a request because of the requester’s inability to pay for copies.

3. 23-ORD-064 (In re: Anne Coorssen/Oldham County Schools)

Summary: Oldham County Schools did not subvert the intent of the Open Records Act when it did not respond to a request it did not receive as a result of a technical error that has since been corrected.
