The Kentucky Attorney General issued the following open records decisions last week:

1. 23-ORD-310 (In re: Troy Buckler/Southeast State Correctional Complex)

Summary: The Southeast State Correctional Complex violated the Open Records Act when it denied a request to inspect records without citing an exception and explaining how it applied to the records withheld. However, the Complex did not violate the Act by withholding records that are exempt from inspection under the Prison Rape Elimination Act.

2. 23-ORD-311 (In re: Richard Jones/Kentucky State Police)

Summary: The Kentucky State Police subverted the intent of the Open Records Act, within the meaning of KRS 61.880(4), by delaying access to requested records beyond five business days from receipt of the request.

3. 23-ORD-312 (In re: Thomas Elza/Eastern Kentucky Correctional Complex)

Summary: The Eastern Kentucky Correctional Complex did not violate the Open Records Act when it denied an inmate’s request for a copy of his presentence investigation report under KRS 439.510.
