The Kentucky Attorney General issued the following open records decisions last week:
1. 23-ORD-280 (In re: James Harrison/Delbert Mays Towing, LLC)
Summary: The Office is unable to find that Delbert Mays Towing, LLC violated the Open Records Act because the Office cannot find that it is a public agency subject to the Act.

2. 23-ORD-281 (In re: Bradley Morris/Mayfield Police Department)
Summary: The Office cannot find that the Mayfield Police Department violated the Open Records Act because the Office cannot resolve the factual dispute between the parties.

3. 23-ORD-282 (In re: Leslie Lawson/Whitley County Detention Center)
Summary: The Whitley County Detention Center did not violate the Open Records Act when it did not provide records that do not exist.

4. 23-ORD-283 (In re: Leslie Lawson/Corbin Police Department)
Summary: The Office cannot find that the Corbin Police Department violated the Open Records Act when it did not respond to a request to inspect records it claims it did not receive.

5. 23-ORD-284 (In re: Carlos Harris/Kenton County Commonwealth’s Attorney)
Summary: The Office cannot find that the Kenton County Commonwealth’s Attorney violated the Open Records Act when he did not respond to a request to inspect records he claims he did not receive.

6. 23-ORD-285 (In re: Kurt Wallace/Metcalfe County Clerk)
Summary: The Metcalfe County Clerk did not violate the Open Records Act when she responded timely to a request to inspect records and charged a copying fee of $0.50 per page for responsive records that do not exist in electronic format. The Clerk also complied with the Act by publishing the agency’s rules and regulations for submitting requests on the agency’s website. However, the Clerk violated the Act when she did not respond to a portion of the request.

7. 23-ORD-286 (In re: Kurt Wallace/Metcalfe County Fiscal Court)
Summary: The Metcalfe County Fiscal Court violated the Open Records Act when it failed to respond to a request for records. The Fiscal Court also violated the Act when it failed to post on its website its rules and regulations for submitting requests to inspect records and the contact information of its official records custodian.

8. 23-ORD-287 (In re: Bobby Inman/Roederer Correctional Complex)
Summary: The Roederer Correctional Complex violated the Open Records Act when it failed to issue a timely response to a request. The Complex did not violate the Act when it did not provide records that do not exist.

9. 23-ORD-288 (In re: James A. Campbell/Luther Luckett Correctional Complex)
Summary: The Luther Luckett Correctional Complex did not violate the Open Records Act when it denied an inmate’s request for a record that does not contain a specific reference to him.
