The Kentucky Attorney General issued the following open records decisions last week:

1. 23-ORD-192 (In re: Simeon McKinnie/Covington Police Department)

Summary: The Office cannot find that the Covington Police Department violated the Open Records Act because this Office cannot resolve the factual dispute between the requester and the agency.

2. 23-ORD-193 (In re: Glenn Odom/Kentucky State Penitentiary)

Summary: The Office cannot find that the Kentucky State Penitentiary violated the Open Records Act because the Office is unable to resolve the factual dispute as to whether the Penitentiary received the request.

3. 23-ORD-194 (In re: Melissa Barlow/Mount Sterling Police Department)

Summary: The Mount Sterling Police Department violated the Open Records Act when it did not respond to a request to inspect records within five business days of receiving it.

4. 23-ORD-195 (In re: Carlos Harris/Eastern Kentucky Correctional Complex)

Summary: The Office cannot find that the Eastern Kentucky Correctional Complex violated the Open Records Act because the Office cannot resolve the factual dispute between the requester and the agency.

5. 23-ORD-196 (In re: Peter Trzop/Nelson County School District)

Summary: The Nelson County School District did not violate the Open Records Act when it did not provide records that do not exist.

6. 23-ORD-197 (In re: Scott Roberts/Trimble County Clerk)

Summary: The Trimble County Clerk did not violate the Open Records Act when she timely responded to a request to inspect records stating the requested records did not exist. However, after those records were created, the Clerk violated the Act when she denied the request without adequately explaining how the exception on which she relied applied to the records withheld.

7. 23-ORD-198 (In re: Tanner Watkins/City of Prospect)

Summary: The City of Prospect violated the Open Records Act when it invoked KRS 61.872(5) to delay access to records without stating the earliest date on which responsive records would be available or giving a detailed explanation for the cause of the delay.

8. 23-ORD-199 (In re: Mark Sommer/Kentucky Department of Revenue)

Summary: The Kentucky Department of Revenue violated the Open Records Act when it denied a request for redacted copies of taxpayer settlement agreements.
