The Kentucky Attorney General issued the following open records decisions last week:

1. 23-ORD-164 (In re: Sydney LaRue/Louisville Metro Police Department)

Summary: This Office is unable to find that the Louisville Metro Police Department violated the Open Records Act because the Office is unable to resolve the factual dispute raised by the Appellant.

2. 23-ORD-165 (In re: Scott Roberts/Bullitt County Clerk’s Office)

Summary: The Bullitt County Clerk’s Office violated the Open Records Act when it failed to issue responses to requests within five business days of receiving those requests.

3. 23-ORD-166 (In re: Johnny Lee Cissell/Lee Adjustment Center)

Summary: The Lee Adjustment Center violated the Open Records Act when its response failed to properly invoke KRS 61.872(5) to delay access to the requested record.

4. 23-ORD-167 (In re: Nick Clark/Louisville Metro Police Department)

Summary: The Louisville Metro Police Department violated the Open Records Act by failing to issue timely responses to requests. The Department subverted the intent of the Act within the meaning of KRS 61.880(4) through delay and excessive extensions of time.

In re: Christopher Wiest/Kentucky Department of Education

Summary: The Kentucky Department of Education violated the Open Records Act when it denied a request for emails or other communications related to certain social media posts over a five-day period.

6. 23-ORD-169 (In re: William Cope/Eastern Kentucky Correctional Complex)

Summary: The Eastern Kentucky Correctional Complex did not violate the Open Records Act when it did not provide records it does not possess.

7. 23-ORD-170 (In re: Charles Sullivan/Wellpath, LLC)

Summary: In the absence of evidence that Wellpath, LLC receives at least 25% of its funds expended in Kentucky from state or local authority funds, Wellpath is not a public agency under the Open Records Act.

Summary: The Kentucky State Police violated the Open Records Act when it failed to issue a response to a request to inspect records within five business days of receipt. The Office cannot resolve factual disputes about whether all records responsive to a request have been provided.
