The Kentucky Attorney General issued the following open records and open meetings decisions last week:

1. 23-ORD-110 (In re: William Michael Fields, Jr./City of Cynthiana)

Summary: This Office cannot find that the City of Cynthiana violated the Open Records Act when it did not respond to requests it did not receive.

2. 23-ORD-111 (In re: Lawrence Trageser/Kentucky State Penitentiary)

Summary: The Kentucky State Penitentiary did not subvert the intent of the Open Records Act, within the meaning of KRS 61.880(4), when it agreed to charge a fee for electronic records that reflected its actual costs of reproduction, as required under KRS 61.874(3). The Penitentiary violated the Act when it withheld the names appearing on a visitor log, but it did not violate the Act when it withheld other personal identifying information under KRS 61.878(1)(a).

3. 23-OMD-112 (In re: Danielle Bell and David Meyer/Kenton County Board of Elections)

Summary: In appeals to the Office under the Open Meetings Act, the Office cannot make findings of fact based on disputed evidence. Accordingly, the Office cannot conclusively determine whether the Kenton County Board of Elections violated the Act when three of its four members submitted to the State Board of Elections a letter in opposition to the removal of its fourth member. However, the Board violated the Act when it failed to adequately explain the basis for its denial of a complaint.

4. 23-ORD-113 (In re: Saeid Shafizadeh/Shelby County Detention Center)

Summary: The Shelby County Detention Center violated the Open Records Act when it did not respond to a request to inspect records.
