The Kentucky Attorney General issued the following open records decisions last week:

1. 21-ORD-148 (In re: Joshua Powell/Fayette County Coroner)

The Fayette County Coroner Office violated the Open Records Act when it failed to respond in writing to a request submitted to it. The Coroner also subverted the intent of the Act by misdirecting the Appellant.

2. 21-ORD-149 (In re: Stephen Zoglman/Kentucky Transportation Cabinet)

The Kentucky Transportation Cabinet violated the Open Records Act when it did not issue a timely written response to a request to inspect records.

3. 21-ORD-150 (In re: The Courier-Journal/Louisville Metro Government)

Louisville Metro Government did not violate the Open Records Act when it did not provide records that do not exist or when it denied inspection of notes taken by an investigator under KRS 61.878(1)(i).

4. 21-ORD-151 (In re: Courier Journal/Louisville Metro Police Department)

The Louisville Metro Police Department violated the Open Records Act when it did not explain how the personal privacy exemption applied to redact certain phone numbers from call logs on Department-owned cell phones. The Department did not violate the Act when it denied a request for text messages and call logs contained on Department employees' privately-owned cell phones.

5. 21-ORD-152 (In re: Christopher Hawkins/Kentucky State Penitentiary)

The Kentucky State Penitentiary did not violate the Open Records Act when it provided records it deemed responsive to an open records request.

6. 21-ORD-153 (In re: Glenn Hayden/Graves County School Board)

The Graves County School Board did not violate the Open Records Act when it timely provided the Appellant an opportunity to inspect responsive records during its regular office hours.

7. 21-ORD-154 (In re: Glenn Hayden/Graves County School District)

The Graves County School District did not violate the Open Records Act when it did not provide copies of records to a county resident prior to his inspection of the records under KRS 61.872(2)(a) and KRS 61.874(1).

8. 21-ORD-155 (In re: re: Christopher Hawkins/Kentucky State Penitentiary)

The Kentucky State Penitentiary did not violate the Open Records Act when it provided records it deemed responsive to an open records request.

9. 21-ORD-156 (In re: Bruce Batchelder/Kentucky Department of Corrections and Kentucky State Penitentiary)

Neither the Kentucky Department of Corrections nor the Kentucky State Penitentiary violated the Open Records Act when they did not respond to a request for records they claim they never received.

10. 21-ORD-157 (In re: Glenn Hayden/Graves County School District)

The Graves County School District did not violate the Open Records Act when it did not provide a copy of a record to a county resident prior to his inspection of the record under KRS 61.872(2)(a) and KRS 61.874(1).
