The Kentucky Attorney General issued the following open records decisions last week:

1. 21-ORD-100 (In re: NorthKey Community Care/Kentucky Public Pensions Authority)

Summary: The Kentucky Public Pensions Authority did not violate the Open Records Act when it denied a request for specific data regarding retirement system members and accounts under KRS 61.661(1)(a).

2. 21-ORD-101 (In re: Stephen McBride/Montgomery County Clerk)

Summary: The Montgomery County Clerk violated the Open Records Act when it did not respond to an open records request. However, it did not violate the Act when it required a request submitted by email to be resubmitted in person or by mail.

3. 21-ORD-102 (In re: Hayden Hodges/Graves County Sheriff's Office)

Summary: The Graves County Sheriff's Office violated the Open Records Act when it failed to explain how an exception to the Act applied to a record it withheld from inspection. The Sheriff's Office did not violate the Act when it denied a request, under KRS 189A.100(2), for a video containing field sobriety testing.

4. 21-ORD-103 (In re: Richard Ciresi/City of West Point)

Summary: The City of West Point violated the Open Records Act when it failed to explain how an exception to the Act authorized it to deny inspection of a record. The City also violated the Act, as modified by SB 150, when it failed to fulfill an open records request within ten days.

5. 21-ORD-104 (In re: Jenny Patten/Cabinet for Health and Family Services)

Summary: The Cabinet for Health and Family Services did not violate the Open Records Act when it provided all responsive records it had in its possession.

6. 21-ORD-105. (In re: C. Michael Shull/Kentucky Communications Network Authority)

Summary: The Kentucky Communications Network Authority violated the Open Records Act when it delayed access to records without initially notifying the requester of the earliest date on which records would be available.
