The Kentucky Attorney General issued the following open records decisions last week:

1. 21-ORD-058 (In re: Edward Dove/Cabinet for Health and Family Services)

Summary: The Cabinet for Health and Family Services did not violate the Open Records Act when it did not provide records that are made confidential under KRS 620.050(5).

2. 21-ORD-059 (In re: Noel Mark Botts/Transportation Cabinet)

Summary: Because the Transportation Cabinet failed to respond to an open records request within ten days, it violated the Open Records Act. However, the Cabinet did not violate the Act when it provided all responsive records in its possession.

3. 21-ORD-060 (In re: Robert Manley/Eastern Kentucky Correctional Complex)

Summary: The Eastern Kentucky Correctional Complex did not violate the Open Records Act when it denied an inmate's request for a record that did not contain a specific reference to him.

4. 21-ORD-061 (In re: Lawrence Trageser/City of Taylorsville)

Summary: The City of Taylorsville violated the Open Records Act when it failed to furnish the name and location of the records custodian for its Ethics Commission. The City also violated the Act when it failed to display a copy of its rules and regulations pertaining to public records in a prominent location, as is required under KRS 61.876.

5. 21-ORD-062 (In re: Lawrence Trageser/Louisville Metro Police Department)

Summary: Because the Louisville Metro Police Department failed to respond to an open records request within ten days, it violated the Open Records Act as modified by Senate Bill 150. The Department did not violate the Act by making redactions consistent with KRS 61.878(1)(a).

6. 21-ORD-063 (In re: Leonel Martinez/Kentucky State Penitentiary)

Summary: Kentucky State Penitentiary did not violate the Open Records Act when it denied an inmate's request for JPay emails because the requested emails are not public records.

7. 21-ORD-064 (In re: Christopher Applegate/Luther Luckett Correctional Complex)

Summary: The Luther Luckett Correctional Complex did not subvert the intent of the Open Records Act with its disposition of a duplicative request to inspect records.

8. 21-ORD-065 (In re: Gary Woolbright/Commonwealth's Attorney for the 43rd Circuit)

Summary: The Commonwealth's Attorney for the 43rd Circuit did not violate the Open Records Act when he denied an inmate's request for a record that would be contained within the Commonwealth's case files.

9. 21-ORD-066 (In re: Jonathan Raikes/Nelson County Judge/Executive)

Summary: The Nelson County Judge Executive violated the Open Records Act when it did not issue a timely response to a request to inspect records.
