The Kentucky Attorney General issued the following open records decisions last week:

1. 21-ORD-050 (In re: Chris Hawkins/Department of Corrections)

Summary: The Department of Corrections violated the Open Records Act when it failed to respond to a request to inspect records. However, the Department did not violate the Act when it did not provide a record that does not exist in its possession.

2. 21-ORD-051 (In re: Anthony Sadler/Kentucky State Penitentiary)

Summary: The Kentucky State Penitentiary did not violate the Open Records Act when it was unable to produce a record that did not exist in its possession or when it denied a request due to the inmate's failure to use the proper form.

3. 21-ORD-052 (In re: Jonathan Fannin/Louisville Metro Police Department)

Summary: The Louisville Metro Police Department did not violate the Open Records Act when it denied a request for the investigative file related to a disciplinary investigation that is ongoing. The Department violated the Act by withholding other public records.

4. 21-ORD-053 (In re: Christopher Hawkins/Kentucky State Penitentiary)

Summary: The Kentucky State Penitentiary subverted the intent of the Open Records Act when it failed to provide all responsive records to an inmate's request.

6. 21-ORD-055 (In re: Jenny Patten/Cabinet for Health and Family Services)

Summary: The Cabinet for Health and Family Services ("the Cabinet") did not violate the Open Records Act ("the Act") when it denied a request for records that did not precisely describe the records sought.

7. 21-ORD-056 (In re: Rick Adams/Governor's Office of Agricultural Policy)

Summary: The Governor's Office of Agricultural Policy violated the Open Records Act when it denied a request to inspect annual reports submitted to it by a private entity in connection with the administration of a loan.
