The Kentucky Attorney General issued the following open records decisions last week:
1. 20-ORD-151 (In re: John W. Potter/Louisville Metro Police Department)
Summary: Under KRS 17.150(2), Louisville Metro Police Department did not violate the Open Records Act by denying a request for a copy of the Risk Assessment Matrix and the Arrest/Search Warrant Information Sheet prepared in relation to the search warrant executed at Ms. Breonna Taylor's residence. However, the Department violated KRS 61.880(1) by failing to issue a timely written response to that request.

2. 20-ORD-152 (In re: Sam Aguiar/Louisville Metro Police Department)
Summary: Louisville Metro Police Department violated the Open Records Act when it failed to cite an exception or explain the basis for redactions made in records it produced for inspection. In addition, the Department violated the Act when it redacted the names of each officer's secondary employer from the Secondary Employment Request forms. However, the Department did not violate the Act when it redacted home addresses under KRS 61.878(1)(a).

3. 20-ORD-153 (In re: Tyler Fryman/Kentucky League of Cities)
Summary: Kentucky League of Cities did not violate the Open Records Act in its response to an ambiguous request for records related to "settlements."

Summary: The Office of the Governor did not violate the Open Records Act when it denied a request for records that do not exist.

5. 20-ORD-155 (In re: Tresa Bridges/Greater Clark Foundation, Inc.)
Summary: In the absence of evidence that Greater Clark Foundation, Inc. receives state or local funds, the Foundation is not a public agency that must comply with the Open Records Act.
