The Kentucky Attorney General issued the following open records decisions last week:
1. 23-ORD-083 (In re: Travis Cannon/Eastern Kentucky Correctional Complex)
Summary: The Eastern Kentucky Correctional Complex did not violate the Open Records Act when it denied inspection of records that do not contain a specific reference to the requesting inmate or a record the disclosure of which would pose a security threat under KRS 197.025(1).

2. 23-ORD-084 (In re: LuvShenda Howard/Cabinet for Health and Family Services)
Summary: The Cabinet for Health and Family Services violated the Open Records Act when it denied a request for records without adequately explaining why.

3. 23-ORD-085 (In re: Carlos Thurman/Green River Correctional Complex)
Summary: The Green River Correctional Complex did not violate the Open Records Act when it denied a request for JPay emails exchanged between private parties because such records are not public records.

4. 23-ORD-086 (In re: Lawrence Trageser/Spencer County Sheriff’s Office)
Summary: The Spencer County Sheriff’s Office violated the Open Records Act when it failed to advise a requester that requested records did not exist. The Sheriff’s Office did not violate the Act when it could not provide records that do not exist.
