Open Meetings Decision

This matter having been presented to the Attorney General in an open records appeal, and the Attorney General being sufficiently advised, we find that the Muhlenberg County Board of Education has, through its Chairman and Interim Superintendent, acknowledged the violation of the Open Meetings Act identified in Anna Marie Cosby's September 9, 2013, complaint and agreed to implement the remedial measures she proposed. In light of the October 2, 2013, correspondence to this office from Chairman Don Richey and Interim Superintendent Sonny Fentress acknowledging the violation and agreeing to implementation of the remedies proposed, there remain no unresolved open meetings issues.

In correspondence directed to this office after she initiated this appeal, Ms. Cosby alleged additional violations that may or may not arise under the Open Meetings Act. To the extent these allegations arise under the Act, they are not ripe for review insofar as there is no indication in the record on appeal that an open meetings complaint containing the allegations was submitted to Chairman Richey. We must, therefore, decline to address these allegations.

A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.846(4)(a). The Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceedings.
