Open Records Decision

This matter having been presented to the Attorney General in an open records appeal, and the Attorney General being sufficiently advised, we find that the Kentucky State Police's reliance on KRS 61.878(1)(h), KRS 61.878(1)(m)1.c., and KRS 61.878(1)(l), incorporating KRS 16.060, in redacting of the names of troopers, assigned to the executive security detail for Governor Ernie Fletcher, Glenna Fletcher and Lt. Governor Steve Pence, appearing on travel reimbursements and expenses paid by the troopers was misplaced and in violation of the Open Records Act. We believe that 05-ORD-255, a copy of which is attached hereto, and incorporated by reference, is controlling. (In that decision, we held that the KSP improperly relied on the above-cited statutes in redacting the names of members of the Governor's executive security detail appearing on fuel receipts for vehicles used to transport the Governor.)

A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
