Open Records Decision
This matter having been presented to the Attorney General in an open records appeal, and the Attorney General being sufficiently advised, we find that the University of Kentucky did not violate the Open Records Act in its response to Scott Sloan's request for a "computerized version of the list detailing salaries for all University of Kentucky employees." We believe that 96-ORD-232 (relating to race and gender) and 99-ORD-12 (relating to date of birth) are controlling. Copies of these decisions are attached hereto and incorporated by reference. Accordingly, we conclude that the University's redaction of the employees' date of birth, race, and gender from the computerized salary list did not constitute a violation of the Act.
A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
