In re:         Ricky C. Branscum/Office of the Commonwealths Attorney for the

        22nd Judicial District

Open Records Decision

This matter being presented to the Attorney General in an open records appeal, and the Attorney General being sufficiently advised, we find that the Commonwealths Attorney for the 22nd Judicial District did not violate the Open Records Act in denying Ricky Branscums September 3, 1999, request for the criminal file in case number 97-CR-253. We believe that 96-ORD-106, a copy of which is attached hereto and incorporated by reference, is controlling.

A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.

LLM Summary
In 99-ORD-185, the Attorney General decided that the Commonwealth's Attorney for the 22nd Judicial District did not violate the Open Records Act by denying Ricky Branscum's request for a criminal file. The decision explicitly follows the reasoning of 96-ORD-106, which is attached and incorporated by reference, indicating that it controls the outcome of this case.
