OPEN RECORDS DECISION

This matter comes to the Attorney General on appeal from the actions of the Montgomery County Ambulance Board relative to Mr. Robert L. Chappel's January 5, 1993, request to inspect the following documents:

1. Minutes of the Board from its inception;

2. A list of the members of the Board and their terms;

3. The Board's secretary's time sheets and salary increments from 1983 to the present;

4. Records reflecting state or federal monies received by the Board from 1983 to the present;

5. Financial records reflecting payments received for ambulance runs from 1983 to the present and tax receipts;

6. Any documents reflecting the number of runs made and the cost for each run from 1983 to the present;

7. The audit for fiscal year 'July 1, 1992 to June 30, 1992 [sic].'

Mr. Chappel indicates that as of the date of his appeal, he had received no response to his request.

We are asked to determine if the Montgomery County Ambulance Board violated the Open Records Act by failing to respond to Mr. Chappel's request. For the reasons expressed in the attached open records decision, 93-ORD-16, we conclude that the Board's actions constitute a violation of the Act, and direct the Board to immediately issue a written response to Mr. Chappel.

The Montgomery County Ambulance Board may challenge this decision by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882.
