Under KRS 64.150 the Jailer was authorized, if ordered by the court to attend court, to receive a $6.00 per day fee. You ask whether he can now be ordered to court?
Under KRS 71.050, the jailer is an officer of the circuit and district courts. Thus he can be ordered by those courts to wait upon court with prisoners. Basically he has immediate custody of the prisoners and is a security guard. He gets no fee, since KRS 64.150 was repealed by H.B. 440, Chapter 385, Section 50, 1982 session (effective July 1, 1982). We are aware of no provisions for paying anything to the jailer for waiting on the court. The jailer is now a salaried official. KRS 441.009.
In the past, you say, several jailers have been ordered by their district judges to receive from an arrestee the sheriff's $10 arrest fee at the time bond is taken.
We suggest that you first take this up with General Counsel for the Administrative Office of the Courts.
