Thank you for your letter requesting a formal opinion concerning the propriety of proxies or designees at a meeting of a district board of health.

This office is of the opinion that, absent specific statutory authority, district board of health members cannot designate "proxies" to act in their stead at district board of health meetings. Since no such specific statutory authority exists, district board of health members cannot designate "proxies."

Enclosed please find a copy of OAG 74-548 which addresses the question of county judge executives designating proxies to represent them at county board of health meetings and which gives detailed reasoning why this office feels that it would be improper for board members to designate proxies.
