Thank you for sending the records which we requested in our letter of February 27, 1981, pertaining to the Open Records appeal of Mr. Ron Parry.

You have previously afforded Mr. Parry the opportunity to inspect records as he had requested and had indicated to him that you were withholding inspection of some records as exempt from mandatory inspection by KRS 61.878(1)(g) which reads as follows:

"Preliminary drafts, notes, correspondence with private individuals, other than correspondence which is intended to give notice of final action of a public agency."

In response to our request for a copy of the withheld records you sent us three items which we have inspected and found to be covered by the exemption as preliminary drafts, notes and correspondence with private individuals.

It is, therefore, our opinion that you acted in accordance with Kentucky Open Records Law in withholding these records from public inspection. We are so notifying Mr. Parry by sending him a copy of this opinion. He has a right to challenge this opinion by an action in the circuit court.

Thank you for your prompt cooperation in this matter.
