Mr. John Frith Stewart has appealed to the Attorney General under KRS 61.880 stating that you failed to comply with his request to send him a copy of each contract between the Board of Education and the current superintendent. Mr. Stewart states that you did send him a complete set of minutes of the June 9, 1981 meeting as requested. Apparently you did not give any explanation for failing to send a copy of the superintendent contracts.

OPINION OF THE ATTORNEY GENERAL

A contract between a superintendent and a school district is a public record and should be made available for public inspection. A requester is also entitled to obtain a copy of the record he has requested to inspect. KRS 61.874.

It is, therefore, the opinion of the Attorney General that you failed to comply with the Open Records Law, KRS 61.870-61.884, when you did not either send Mr. Stewart the records he requested, tell him where and when he could inspect the requested records or give him a written response denying the record with an explanation based on a statutory exception.

As directed by statute we are sending a copy of this opinion to Mr. Stewart.
