You have requested the opinion of this office concerning the application of Elsie Neal, Welby Neal and Denton Neal for a patent to 9.6 acres of vacant and unappropriated land in Clinton County, Kentucky.

The papers include (1) a copy of a court order entered February 20, 1981 by the Judge Executive of the Clinton County Court authorizing Elsie Neal, Welby Neal and Denton Neal to enter, appropriate and patent 9.6 acres of land in Clinton County upon payment of a sum of $960.00, (2) the affidavit of the surveyor, Charles Campbell, that the land in question has not to his knowledge or belief been previously entered or surveyed or patented, and (3) the original plat and certificate of the surveyor.

Since the application includes a copy of the court order under which the survey was made, the original plat and certificate of survey and the affidavit of the surveyor, it is our opinion that the application shows compliance with the provisions of KRS 56.210, 56.230 and 56.240 and that the patent should be issued.
