In your letter to the Attorney General dated June 8, 1981, you pointed out that OAG 65-414 and OAG 80-447 reach opposite conclusions as to whether a promoter must obtain a license and permit in order to have a closed circuit television wrestling and boxing exhibition.

KRS 229.021 and 229.071 require any person conducting a professional boxing or wrestling match to obtain a license from the Commission. KRS 229.011(5) defines a professional match as a boxing, sparring, or wrestling match or exhibition and KRS 229.011(2) defines exhibition as including "a public show or showing through the medium of closed circuit television to which an admission ticket is required, or other charge is made."

Therefore, OAG 80-447 is hereby modified to conform with OAG 65-414 to the extent that a promoter is required to obtain a license and permit in order to conduct a closed circuit television wrestling or boxing exhibition. However, with respect to questions two (2) and three (3), OAG 80-447 does not conflict with OAG 65-414 and is not modified.
