This is in answer to your letter of November 8 in which you raise the following question:
"One of our newly elected Councilmen is also the vice-president of the Providence - Webster County Chapter of the N.A.A.C.P. We would like your opinion on whether this is permissible or not."
The position of vice-president of the Providence - Webster County Chapter of N.A.A.C.P. is not a public office. Incompatibility is based on the holding of two incompatible offices or employment at the same time as provided in § 165 of the Constitution and KRS 61.080. There is however no constitutional or statutory incompatibility for an elected official, such as a member of the city council, to hold at the same time an office in a privately incorporated association, such as the N.A.A.C.P.
