This is in answer to your letter of November 14 concerning the recently passed referendum levying a ten cents (10 ) increase in your taxes for library purposes. In connection with the passage of the library tax, you raise the following question:

"The question is, was there a required time, before the election, that this Library Question should have been advertised, via newspaper or otherwise made public in a manner that would have better informed the voters."

The only publication requirement prior to the library referendum question being presented to the voter would be the fact that said question must be published along with and as part of the face of the ballot pursuant to KRS 424.290.

The ballot face containing all of the election information that will be submitted to the voter at the election must be published by the county clerk not less than three (3) days before the election. Assuming that the library question was so published, the voters were adequately informed of the nature of the question prior to the election. We find no publication requirement other than this with respect to the library tax referendum which we assume pertained to the county library district established pursuant to KRS 173.450 to 173.650.
