This is in answer to your letter of December 8 in which you, as a member of the Middlesboro City Council, request an opinion concerning the following:

"Would it be legal for a Councilman or Mayor to vote to lower his or her salary while serving as a member?"

The answer to your question would be in the negative in view of the provisions of KRS 64.580 as well as Section 161 of the Constitution which prohibit any change in the compensation of elected city officers, including constitutional officers such as the mayor and members of the city council, during their term of office.
