This is in answer to your letter of November 29 in which you raise the question as to whether the fiscal court or the planning commission has the authority to employ staff and personnel for the planning commission.

In response to your question, reference is made to KRS 100.173, which reads as follows:

"The planning commission may employ a staff or contract with planners or other persons as it deems necessary to accomplish its assigned duties under this chapter."

Under the terms of the above statute it is clear that the planning commission is authorized to employ the necessary personnel to assist the commission in the performance of its duties.
